In the last Kenyan Presidential petition that led to the nullification of the October 8th, 2017 general election, many people wanted Mwilu to be disqualified from hearing the appeal due to their relationship with the ODM Senator.
At one point, it was believed that their relationship could result in an unfair ruling in favor of the ODM party (one of the critical parties of NASA) that presented the petition.
